Contributor Terms

These Contributor Terms (Terms) apply to all Contributors to this Website. We may modify and update these Terms at any time, without notice. You need to ensure you review the Terms from time to time. In using the Website or submitting any Story to the Website, you agree to be bound by these Terms as well as any general terms and conditions, policies, regulations and guidelines on the Website from time to time.

Definitions

Contributor and You means the person submitting a Story to the Website for publication;

Story means any story, including any material, links, words, images and videos, submitted to and published on the Website;

We, Our and Us means the business Swimpeople.com.au and all directors, employees and contractors from time to time.

Website means www.swimpeople.com.au.

General User Agreement

You agree and warrant that:

• You are at least 18 years of age or you have your parent’s permission to submit Stories to the Website;

• Any Story that you submit to the Website is your own and will not breach any copyright, or be considered misleading, deceptive, defamatory, offensive or otherwise illegal;

• If you are not the owner of a Story, you have permission from the owner for it to be submitted to and published on the Website;

• We will only publish a Story on the Website once we have both agreed to the final draft;

• We will not publish any personal contact or other information as part of a Story on the Website;

• We reserve the right at all times not to publish a Story for any reason and you will have no recourse against us;

• Once we have both agreed to the final draft of a Story, we will not make any material changes to it. However, we have the right to make necessary edits to the Story from time to time, so that it fits any guidelines, policy, layout or other requirements of the Website or any other site.

• We will credit any Story that you submit to you, using the name that you give us. We will only accept your true, correct, legal name for publishing purposes;

• You grant us a non-exclusive, irrevocable licence to reproduce, publish and deal with any Story that you submit, free of charge, including;

• Publishing the Story and also using it for promotional purposes on the Website, any social media site, any media outlet, and any other website;

• Using, reusing and granting others the right to use and reuse the Story, and any reproduction or similar, in any form of media or technology, for any purpose related to the Website;

• You will not at any time claim any revenue, profit, royalty or cost from us for receiving or using any Story in accordance with these Terms;

• You will retain copyright ownership of any Story that you submit to the Website. If someone else is the owner of the Story, then they will retain copyright ownership of the Story;

• You must not republish or share another person’s Story that is published on the Website unless you have the written permission of the owner, which you may request through us;

• All custom graphics, icons, logos, trademarks and service marks on the Website are the copyright and property of ourselves or their respective owners.

These Terms do not grant you any right to use them.

Liability

Unless required by law, we are not liable for any loss you may suffer as a result of your use of the Website. This includes direct, indirect, consequential or special damages, and any loss of royalties, profits, goodwill, business opportunity, reputation, data or information, or any business interruption, injury, or personal or property damage.

Indemnity

You will fully indemnify us at all times against any kind of claim, demand, costs, damages or award resulting from your use of the Website or from any infringement of intellectual property by you.

Governing Law

These Terms are governed by the laws of New South Wales and you agree to submit to the exclusive jurisdiction of the Courts of New South Wales for determining any dispute concerning these Terms.
